WHALERS COVE TERMS AND CONDITIONS

ARRIVAL AND DEPARTURE TIMES

So as to allow time for the villas to be cleaned guests are advised that check-in time is from 2.00pm and check out time prior to 10.00am on the morning of departure. If arriving after 5:00pm special arrangements are to be made with management.

EARLY ARRIVALS

There is a charge for early arrivals:

  • $50 if arrive between 8am and 12pm.
  • After 12pm and before 2pm is at no charge providing the villa is available.

LATE DEPARTURES

There is a charge for late departures on the following scale:

  • $20 for each hour up to 4 hours and;
  • From thereafter 50% of the nightly tariff will apply.
  • No refunds for early departures

ACCOMMODATION PURPOSES

Whalers Cove Villas are rented for accommodation purposes only. Wedding receptions, functions and large gatherings are not permitted and if evidenced will be closed down immediately and guests asked to vacate.

BABY HIRE

Baby Cots, High Chairs and Stair Guards are available for hire. Please book these in advance as we have a limited number available.

BBQ's

It is asked that BBQ's are cleaned prior to departure (including emptying of fat from the drip trays). Failure to clean BBQ's will incur an additional cleaning cost of $25. Please ensure gas cylinders are turned off after every use. BBQ's are not to be moved.

BOND

The guest's credit card details will be taken with signed authority to debit any amount if necessary. This will cover extra cleaning that may be required, damage arising during the duration of the guests stay and late departures. The card details will be destroyed should no extra expenditure occur. If incoming guests are unable to provide credit card details then a bond of $500 cash is payable before or on arrival.

BOOKING INFORMATION AND CONDITIONS

  • Payments for bookings can be made by cash, credit card, EFTPOS or bank transfer.
  • Only VISA & Mastercard Credit or Debit cards are accepted.
  • A deposit of 30% or accommodation tariff is required to secure the booking.
  • In peak periods, the balance of accommodation is due six (6) weeks prior to arrival.
  • At all other times, the balance of payment must be made prior to or on arrival.
  • If a booking is made less than four (4) weeks prior to arrival date then full payment of the accommodation costs is required.
  • A tentative booking will be held no longer than 3 days.

Tariffs do not attract GST.

CANCELLATION POLICY

A cancellation fee applies to all bookings:

  • More than 30 days prior to arrival date - full refund less $50 admin fee
  • 14 to 30 days prior to arrival date - full refund less 50% of total tariff unless a replacement booking is received, then a $50 admin fee will apply.
  • Less than14 days prior to arrival date - total tariff payable – no refund unless a replacement booking is received, then a $50 admin fee will apply.
  • Travel Restrictions due to COVID If there are travel restrictions imposed as part of Government Policy, we are happy for you to postpone your booking or offer a full refund, your choice.

Note: No refunds are given for early departures and all cancellations must be in writing.

CHANGES TO BOOKINGS

A fee may be charged for any change in a booking such as changing a villa or reducing the number of days of the booking.

VILLA CHANGE
If, in the case of a villa being changed, a $100 fee may apply.

REDUCTION IN NUMBER OF DAYS
Fees will be applied as follows for reducing the length of stay:

  • More than 30 days prior to arrival date - $100.
  • 14-30 days prior to arrival date - full refund less 30% of total tariff of the number of days cancelled.
  • 7-14 days prior to arrival date - full refund less 50% of total tariff of the number of days cancelled.
  • Less than 7 days prior to arrival date - no refund applicable.

CHANGES TO TARIFFS

At times situations arise of which we have no control. Whalers Cove Villas Management reserves the right to move guests to alternate accommodation, subject to availability, at their discretion or the direct instruction of the villa owner. If this is the case, we will notify you as soon as possible. Rental tariffs may be subject to increase without notice. Should this occur you will be notified and given the opportunity to pay the difference in tariff or receive a full refund of your deposit. We will also offer you alternate accommodation if possible.

CLEANING

It is expected that the villa will be left how you found it, that is in a clean and tidy condition with the dishwasher emptied, rubbish removed etc. If the villa is not left in a presentable condition, an additional cleaning fee will be incurred and this will be deducted from your credit card.

CONSUMABLES

A starter pack is provided for you consisting of cleaning agents for the kitchen, laundry and bathroom as well as some toilet paper. We also provide a starter pack of milk, tea, coffee and sugar. Please note that this is a starter pack and additional items can be purchased from the office or local supermarkets if required.

DAMAGES/BREAKAGES

Any damage or breakages in the villa or its contents or common property must be reported to the office before departure. All breakages and damage may incur a charge. If there is unreported damage or breakage in your villa a fee will be applied to your credit card/bond to cover the cost of repair or replacement. If any items are missing they will be presumed broken and a fee to replace will be charged to your credit card.

FIRES
During the winter months a starter pack of matches, paper, firelighters, kindling, medium and large wood will be provided to those villas with wood fires. If you require extra firewood, it is available for sale at $15 per bag from the office during office hours of 8:30am - 6:00pm. Please enjoy your fire but use your wood correctly as kindling and medium wood is designed only to get the fire going and not for continual burning (use large wood once fire is established). Please do not light your fire before departure as it will need to be cleaned before the next guests check in. NOTE: If firewood other than that provided by Whalers Cove Villas is used there may be a charge of up to $200 for cleaning the flue and firebox.

INSURANCE

We recommend that guests take out comprehensive holiday cancellation and protection insurance to cater for any unforeseen circumstances that may cause guests to cancel their booking or for loss of personal items from villas. All guests are responsible for keeping the property secure during their stay and will be responsible for any theft or damage due to neglect in this area. No responsibility is taken for guests personal property left on or near the premises. No liability is accepted for any injury, debt, damage, loss, delay, expense or inconvenience caused directly or indirectly by events beyond managements or the owner’s control.

INTERNET
Free WiFi is provided.

KEYS

Keys to be returned to reception before departure. If keys are not returned a fee of $25 will be applied to your credit card. There is a locked key return slot outside the office for early departures. A maximum of 2 sets of keys per tenancy can be provided.

LEAVERS

Sorry we do not allow any Leavers, with or without parents. If any Leavers related accommodation is booked, the full payment will be forfeited at time of check in and you will be asked to leave the resort.

LEFT ITEMS

Items found will be held for claiming for a maximum of 2 weeks and if not claimed donated to charity. If items are claimed there is a postage and handling fee of a minimum of $15 to return the items.

LINEN

All prices include sheets and towels (not beach towels). Extra linen is available for hire from reception.

MOORINGS

Whalers Cove has three (3) moorings available for use at your own risk. Management takes no responsibility for the boats security.

NOISE

We ask that all visitors who are not house guests depart from the resort by 10pm. We ask that house guests be aware of others around them and keep the noise to a minimum. There is to be no loud noise after 10pm. The management reserves the right to enter and inspect the villa at any time and for whatever reason.
Failure to comply with the noise restrictions may result in the guests being asked to move inside and if the problem continues guests may be asked to leave the property as per the Innkeepers Act and no refund will be made.

If Managers are called out due to a noise complaint a $100 call out fee will be charged.

NUMBER OF GUESTS

Bookings are based on 4 people per villa. For every extra person, there is a charge of $15 per person per night for the entire stay. This means the nightly rate increases by $15.No charge for children under 12 years of age (except Villa Oriole where only children under 5 years of age are free)

Each holiday villa is equipped for a specific number of guests. It is against Health Department regulations for more persons to occupy a property than there are beds to accommodate them. If a property is reported to be overloaded, the guests will be asked to vacate with no refund made. No mattresses, tents or caravans/campers are allowed.

OFFICE HOURS
Office hour are 8:30am – 6:00pm

PARKING

As per strata by-laws, each villa has parking provided for two (2) guest's cars. Extra cars or visitors may park vehicles in Lecaille Court or by alternative arrangement in consultation with management.

PETS

Sorry, we do not allow pets. If pets (includes friends visiting with pets) are found there will be an extra cleaning fee imposed at a minimum of $100. The pet must be removed immediately from the resort.

RETICULATION

The grounds of Whalers Cove are watered by reticulation on Monday and Friday mornings. Please DO NOT touch or alter the reticulation settings

RIGHT TO REFUSE OR REVOKE BOOKINGS

The Managers of Whalers Cove and the property owner reserve the right to revoke or refuse to honour any accommodation booking which may in the opinion of either the managers or owner, (and at their sole discretion) be unsuitable for the property concerned. The same right to revoke or refuse a booking applies should guest's details prove to be inaccurate. In such instances a full refund will be given.

RUBBISH

Recycling (yellow lids) and normal rubbish bins are provided. The green bins are emptied every Tuesday morning and the recycling bins every 2nd Tuesday. The bins will be collected from each villa on Monday afternoon for the Tuesday collection. If you have rubbish for the bins and they have been moved already please take it to the bins on Lecaille Court near the Whalers Cove entry.

SEASONS

High: Easter (4 night minimum); Long Weekends (3 night minimum); Christmas School Holidays – December - February (7 night minimum); Gourmet Escape (min 3 nights)

Mid: February – May, September – December, all school holidays except Christmas

Low: May – September (excludes long weekends and school holidays)

Note; please check website for actual dates of the seasons and applicable tariffs.

SERVICING

As we are fully self-catering, the villas will not be serviced until your day of departure. Each villa is equipped with cleaning equipment and we ask you leave your villas in a clean and tidy condition upon departure. Dishes to be washed and returned to cupboards before departure including emptying the dishwasher. If the villa is left in an untidy condition a minimum of a $65 fee will be applied to your credit card.

If any items of crockery, cutlery or furniture are moved between villas and not returned to the correct villa, there will be a minimum of a $60 fee applied to your credit card to cover the costs of replacing these items.

If you wish to have a mid-clean during your visit (applies for visits with a minimum of 10 days), this can be arranged with a cleaning fee to be advised by the Managers. Please let the Management know if you would like a mid-clean at the time the booking is made.

SMOKING - NO

There is no smoking permitted inside the villas. Guests are asked to not smoke close to doors and windows and to dispose of cigarette ends thoughtfully by placing them in the bin.

If guests do smoke in the villa they will be asked to leave immediately and no refund will be given. There will also be a $300 cleaning fee applied to your credit card as couches and furnishings will require a special dry clean.

VILLA CONTENTS

All villas are equipped with iron and ironing board, tv’s and dvd’s overhead fans, microwaves, full kitchen facilities including a dishwasher, fridge/freezer, hairdryers, stereo, gas BBQ’s, outdoor settings, washing machine and dryers.
All villas are individually furnished and have their own crockery and cutlery. If any of these items are moved between villas we ask that they are returned before departure. Failure to do this will incur a fee of a minimum of $60.

VILLA OWNERSHIP
All properties under Whalers Cove Villas Management are privately owned and are rented on a fully self-contained basis. In the event of faults and or malfunctions of appliances or inclusions there is no obligation from the owner of Whalers Cove Villas Management to compensate or discount.

When a booking is made, the deposit is accepted for the owner at that time. If the villa is for sale and ownership changes before your holiday we cannot guarantee that the villa will remain available. We cannot accept responsibility for decisions by a new owner. If the villa is sold you will be notified. If alternate accommodation is not available you will receive a full refund. If your villa is listed for sale whilst you are in residence, the occupier agrees to allow the owner or agent to conduct inspections with prospective purchasers at mutually convenient times by appointment.

VISITORS
You are responsible for the conduct of visitors in the villa. Please ensure your visitors abide by the house rules.
